Abstract
The family has been a basic social unit in all civilized nations. The formation of a new family begins with marriage. The desire of both parties is that this marriage should move forward and as a result a new family should be formed. The ways of marriage may be different. Marriages are performed according to the customs and traditions of different regions. It turns out that religion is playing a key role in the marriage process. This social contract of marriage is formed on the basis of religion. Therefore, the concept of marriage in the divine religions is based on its rules and regulations and the rights and duties of the parties. The main purpose of marriage is to form a family and satisfy natural desires. Islam has also given importance to marriage in the formation of family and has explained its rules and regulations. There are many reasons why it is sometimes difficult or impossible to maintain this relationship. The bond should be left as it is, whether it results in many lives being at stake or the relationship being broken out of mutual respect so that the path of the husband and wife may be separated. This article discusses the conceptual aspect of shar’i divorce in Ja’fari school of thought and discusses important topics of divorce such as types of divorce, terms & conditions of divorce, witnesses for divorce, conditions of divorcees and conditions of divorce in Ja’fari school of thought.
